Taiwan's 3 steel mills reverse US' AD ruling against corrosion-resistant steel

The US Courts of Appeals recently overturned the US Department of Commerce (USDOC)’s anti-dumping ruling against certain corrosion-resistant steels of Yieh Phui, Prosperity Tieh Enterprise, and Synn Industries, and pointed out that the USDOC’s decision to calculate dumping rates of each company was illegal.

In 2015, in response to AK Steel’s complaint, the USDC conducted an anti-dumping investigation on corrosion-resistant steels of Taiwanese steel mills. However, in the preliminary ruling, it separately determined that the dumping rate of Yieh Phui and Prosperity Tieh Enterprise was 0%, and subsequently determined the dumping rate at 10.34% of the three companies.

Therefore, Yieh Phui and Prosperity Tieh Enterprise appealed to the US Court of International (CIT) and complained that it would be illegal to calculate anti-dumping duties. However, CIT still supported the original USDC's ruling.

The US Courts of Appeals finally ruled that the USDOC's decision was illegal and lacked a sufficient basis, so the original decision was revoked and the case was returned to CIT for retrial.
